Terms of Use

These Terms of Use govern your use of DailyLabel ("the App"), a mobile application developed and operated by BitTech LLC ("we," "us," or "our"). By downloading or using the App, you agree to these terms. If you do not agree, do not use the App.

License

BitTech LLC grants you a personal, non-exclusive, non-transferable, revocable license to use the App on any Apple device you own or control, subject to these Terms and Apple's App Store Terms of Service. You may not copy, modify, distribute, sell, or sublicense any portion of the App.

Acceptable Use

You agree to use the App only for its intended purpose — personal nutrition tracking. You may not use the App to violate any applicable law, transmit harmful content, reverse engineer the software, or interfere with the App's operation or integrity.

Health Disclaimer

DailyLabel is a personal reference tool and is not a substitute for professional medical or dietary advice. The % Daily Value figures displayed are based on the FDA's standard 2,000-calorie reference diet and are for informational purposes only. Always consult a qualified healthcare provider before making significant changes to your diet.

Nutritional Data Accuracy

Nutritional values displayed in the App are sourced from third-party databases and user input. BitTech LLC does not independently verify the accuracy of this data. Actual nutrient content may vary based on brand, preparation, serving size, and other factors. You assume full responsibility for any decisions made based on nutritional information provided by the App. BitTech LLC makes no representations or warranties regarding the accuracy, completeness, or reliability of any nutritional data.

Intellectual Property

All content, design, code, and trademarks associated with DailyLabel and BitTech LLC are the exclusive property of BitTech LLC. Nothing in these Terms grants you any rights to our intellectual property beyond the limited license described above.

In-App Purchases

The App offers a one-time Pro upgrade through Apple's in-app purchase system. All purchases are final and subject to Apple's purchase and refund policies. We do not process payments directly — all transactions are handled by Apple.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranty of any kind, express or implied. BitTech LLC does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

To the fullest extent permitted by law, BitTech LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the App, even if we have been advised of the possibility of such damages. In no event shall BitTech LLC's total liability to you exceed the amount you paid for the App in the twelve months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless BitTech LLC and its members, officers, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the App, your violation of these Terms, or your reliance on any nutritional data provided by the App.

Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be resolved by binding arbitration administered under the rules of the American Arbitration Association (AAA), rather than in court. The arbitration shall take place in Mississippi, and the arbitrator's decision shall be final and binding.

Class Action Waiver: You agree that any arbitration or legal proceeding shall be conducted only on an individual basis and not as a class, collective, or representative action. You expressly waive any right to bring or participate in a class action lawsuit or class-wide arbitration against BitTech LLC.

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.

Governing Law

These Terms are governed by the laws of the State of Mississippi, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Mississippi.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
